A particular ruling ended this week with the dispute between the Canadian salmon company, Cooke Aquaculture Chile, and the Environmental supervisor (SMA).

The Cooke Seafood subsidiary asked the Third Environmental Court to suspend a resolution that crippled the planting of a center in the Aysén region.

There, the company had 170,000 salmon in freshwater fish farms that needed to be transferred to the marine environment, according to what was announced by the Financial journal.

Both sides had discussed whether or not the center in question would be within the San Rafael Lagoon National Park.

Despite this, the ruling noted that the measures that could be enacted are “unnecessary”.

This since the order of the SMA expired January 1, 2023, so the restriction was not in effect.

The court then reminded that the fertilizer centers must sow all specimens within a maximum period of three months.

According to the ruling, this term would have expired at the beginning of January, so “It is not possible to enter more fish at CES Huillines 3”.

Response from the Canadian salmon company

After learning of the ruling, the Canadian salmon company issued a public statement.

“The resolution of the Third Environmental Court reveals a denial of justice” indicated, in addition to criticizing the setting for “refusing to resolve the merits of the claim”.

Cooke Aquaculture insisted the actions were of the court “arbitrary” and “illegal”.
